Notice is hereby given that the City of Moss Point, Mississippi, will receive sealed bids at the Mayor’s Office, City Hall, until 2:00 p.m. on Thursday, the 9th day of November 2023, for the following:

AMERICAN RESCUE PLAN ACT (ARPA) -
Sewer Replacement Project

The work for which proposals are invited consists of the furnishing and installing of new sewer lines and manholes to replace existing asbestos sewer piping. The location of this project is Bay Avenue in Moss Point, Mississippi.

Bids are due at 2:00 p.m., Thursday, November 9, 2023, and may be submitted electronically at www.cityofmosspointbids.com, or either be mailed or hand-delivered to: City of Moss Point, City Clerk’s Office, 4320 McInnis Ave, Moss Point, MS 39563. Bids submitted by e-mail or fax will not be accepted. The bid opening will take place at 2:00 p.m. at Moss Point City Hall Meeting Room, 4320 McInnis Avenue, Moss Point, MS, and will be open to the public. The City of Moss Point reserves the right to accept or reject any bids.

If bids are submitted electronically, the same requirements for submitting sealed bids shall apply. Electronically submitted bids shall include a document with the first page stating the same language required on the face of the sealed envelope.

The successful bidder will be required to furnish a 100% Payment and Performance Bond if the bid equals or exceeds $25,000. If the bid is less than $25,000, the City of Moss Point may elect to make a lump sum payment at the completion of the job, in which case a payment and performance bond shall not be required.

Proposals must be accompanied by a Proposal Guaranty consisting of a Bid Bond, Cashier’s Check or Certified Check in the amount of 5% of the amount of the bid.

All persons having a contract with the City of Moss Point must adhere to the City’s policy concerning non-discrimination without regard to race, creed, color, age, sex, national origin, or handicap.

On bids which equal or exceed $50,000, Certificate of Responsibility classification issued by the Mississippi State Board of Contractors shall be written on the outside of the envelope containing the bids. Bids of less than $50,000 will be marked on the outside that the bid contained within does not exceed $50,000.

Bids which are for work outside of the classification listed for any bidder may be deemed unresponsive.

Bid documents are being made available via original paper copy. Plan holders are required to log-in or to register for an account at www.cityofmosspointbids.com to view and order bid documents. All plan holders are required to have a valid email address for log-in or registration. Bid documents are nonrefundable and must be purchased through the website. Preference shall be given to resident contractors, and a nonresident bidder domiciled in a state, city, county, parish, province, nation, or political subdivision having laws granting preference to local contractors shall be awarded Mississippi public contracts only on the same basis as the nonresident bidder’s state, city, county, parish, province, nation or political subdivision awards contracts to Mississippi contractors bidding under similar circumstances. To ensure that Mississippi’s so-called Golden Rule is followed, state law requires a non-resident bidder to attach to his bid a copy of his resident state’s current law pertaining to such state’s treatment of non-resident contractors. Resident contractors domiciled in Mississippi, be they corporate, individuals or partnerships, are to be granted preference over nonresidents in awarding of contracts in the same manner and to the same extent as provided by the laws of the state, city, county, parish, province, nation, or political subdivision of domicile of the nonresident.

The ability to obtain any insurance required by the contract documents which does not require proof of coverage to be contained in the submitted bid (such as bid bonds), must be demonstrated in the bid by the means specified in the contract documents. Proof of actual insurance coverage must be submitted within five (5) business days from the bid acceptance.

In compliance with the laws of the State of Mississippi, in choosing materials for the project, the successful bidder shall be required to give preference to materials grown, produced, prepared, made, or manufactured within the State of Mississippi. The foregoing notwithstanding, no preference shall be given to materials grown, produced, prepared, made or manufactured in the State of Mississippi when other materials of like quality produced outside the State of Mississippi may be purchased or secured at less cost, or any other materials of better quality produced outside the State of Mississippi can be secured at a reasonable cost. The Contractor shall not use any materials on the project that are grown, produced, prepared, made, or manufactured outside of the United States. If such materials are not available, then those which are grown, produced, prepared, made, or manufactured outside the United States may be used.

Minority and women’s business enterprises are solicited to bid on this contract as prime contractors and are encouraged to make inquiries regarding potential subcontracting opportunities and equipment, material and/or supply needs.

Written questions may be submitted by mail to the address shown above, by e-mail or FAX. The question period will end at 5:00 pm, 7 calendar days prior to the bid opening date.

Contract time shall be 120 consecutive calendar days from the Notice to Proceed Date. Liquidated damages will be assessed for each consecutive calendar day thereafter in the amount of Five Hundred dollars ($500.00).

Special Damages – In addition to the amounts provided for liquidated damages, Contractor, in the event of such default, shall pay to the Owner the actual costs reasonably incurred by Owner for engineering and inspection forces employed on the work after the time stipulated for completion of the work and other costs as may be reasonably incurred.

Bidder must be qualified under Mississippi Law and show current Certificate of Responsibility issued by the Mississippi State Licensing Board for Contractors establishing his classification as to the value and type of construction on which he is authorized to bid.

Bid Award

The City of Moss Point, MS reserves the right to accept or reject any or all Bids or parts of Bids, to waive any formalities and technicalities. Awards, if made, will be made from the lowest and best Bid and the Bid most advantageous to the OWNER. No bid may be withdrawn until the expiration of Ninety (90) days from the date bids are opened.
